Registration with Kettering Borough Council – Small Society Lottery Certificate No. 20/00045/GALOTT

1.         Purpose

1.1.      The 1st Kettering (Parish Church) Scout Group’s (“The Group”) 59 Club (“the 59 Club”) is a lottery intended to raise funds for the 1st Kettering Scout Group.

2.         Legal Status

2.1.      The 59 Club is registered with Kettering Borough Council (“KBC”) as a Small Society Lottery, and will operate under the relevant legislation.

2.2.      The Promoter of the 59 Club (“The Promoter”) will be a Group Executive Committee (“The Committee”) member appointed by the Committee. The Promoter’s contact details will be available on the 59 Club page on the Group’s website.   

2.3      The Rules of the 59 Club will be available on the 59 Club page on the Group’s website (http://www.1stkettering.co.uk), and available upon request to the Promoter.

2.4      The maximum number of Subscribers to the 59 Club is 59 and only appropriately registered persons can participate.

2.5      The maximum value of tickets sold by the 59 Club will be £4,200 per annum or £350 per monthly draw. The value of a single monthly ticket (or “chance”) will be £5. The maximum value of prizes given in each monthly draw will be 50% of the value of the tickets sold, or £100 – whichever is the lower figure.

2.6      Expenses incurred (other than for prizes) will be kept to a minimum. All expenses incurred (even when covered by donations) will be recorded and publicised.

2.7       Returns of financial and other details of the 59 Club will be submitted to KBC at least once per annum as required by legislation and posted onto the Group’s website

3.         IT Systems

3.1The Group will hold all personal data on an on-line website, OSM (“OSM”), currently owned and operated by an independent external organisation entitled Online Youth Manager Ltd. This is a national data management system used by the Group. Further details of the Security and GDPR compliance are contained on the OSM website (onlinescoutmanager.co.uk).

3.2      The Group may at any time at the sole discretion of the Committee decide to use an alternative data handling system to hold the personal data. This will be communicated to all participants.

4.         Operation

4.1      Applicants wishing to participate in the 59 Club (“Subscribers”) must register onto OSM via the 59 Club link on the Group’s website.  Applicants requiring assistance to register on OSM may contact the Promoter. Subscribers must provide:

–     their full name;

–     date of birth;

–     postal address; and

–     email address.

4.2       The 59 Club is open to anyone over the age of 18 years old, including members of the Committee and leaders of the Group. All participants must comply in full with the Rules.

4.3      Monthly draws will begin once an agreed level of subscription (“the Trigger Level”) has been reached. The initial Trigger Level is set at £150 per month – i.e. 30 subscribers.

4.4       When the 59 Club becomes operational for the first time, the Promoter will invite the Subscribers via email to log into the OSM system and complete the on-line Direct Debit mandate and funds will be taken at the next appropriate date.

4.5      Payment for tickets for the 59 Club will be made by Direct Debit only. Subscribers will be able to pay with either 12 monthly, 6 monthly, or 3 monthly payments. No other form of payment will be accepted. All payments will be processed via OSM.  

4.6      When the 59 Club is operational, the Promoter will activate the Direct Debit payment via the OSM system. Direct Debits will be taken for the following month’s draw on the first working day following the 10th of the preceding month (e.g., the payment will be made on 10th January for the February draw).

4.7      If the Subscriber’s contribution has not been received by 23.59 on the 27th of the preceding month for whatever reason, the Subscriber’s number will be withdrawn from that month’s draw.

4.8       The Promoter will notify the Subscriber if their monthly Direct Debit fails (i.e. is rejected by the Subscriber’s bank) and will advise the reason given for that rejection. It is the Subscriber’s responsibility to resupply bank details via OSM and to notify the Promoter that this has been undertaken. The Subscriber will not be re-entered into the 59 Club draws until the first month for which payment using the new Direct Debit mandate is received.  Having notified a Subscriber that their Direct Debit has failed, the Promoter is under no obligation to make any further follow up contact with the Subscriber but, at the Promoter’s sole discretion, may do so.  

4.9      If the number of Subscribers falls below the Trigger Level, the 59 Club and all associated Direct Debits will be suspended. If the number of Subscribers remains below the Trigger Level for three months, the Group may take the decision to close the 59 Club.

4.10    Each Subscriber will be allocated permanently the same number(s) in the range 1 to 59.

4.11    Physical tickets will not be issued to Subscribers. A list of the numbers included in each month’s draw will be available for examination by Subscribers before each draw is conducted upon request by the Subscriber to the Promoter.

4.12    One draw will be conducted each month, so long as Subscriber numbers remain above the Trigger Level.

4.13    The winning number of any individual month will reflect the Bonus Ball of the first National Lottery (“Lotto”) drawn after 00.01 on the 1st of that month – on either the Wednesday or Saturday draw.

4.14    Should the Bonus Ball number from the first Lotto draw that month be an unallocated 59 Club number that month, then the draw will be continuously rolled over to the next National Lottery draw in that month until one of the allocated numbers is drawn (e.g., Saturday 1st’s drawn Bonus Ball is a blank 59 Club number, so Wednesday 5th’s drawn Bonus Ball will be that month’s winner … and on to Saturday 8th until an allocated number is drawn).

4.15    Should no allocated number be drawn in any one month, the prize for that month will be rolled over until it is won.

4.16    All Subscribers will be notified each month by email of the winning number within 72 hours of the draw taking place and whether the prize has been won or rolled over. A list of winners in the 12 months to 31st March will be included within the Group’s Annual Financial Report; posted on the Group’s website and will be available for inspection upon request by the Subscriber.

4.17    No refunds of tickets can be offered for any monthly draw after 00.01 on the 27th of the preceding month.  Should a Subscriber wish to withdraw from the 59 Club, they should notify the Promoter in writing or by email. The Promoter will action the request as quickly as possible and will suspend that Direct Debit.  The previously allocated permanent number will become available for offer to new Subscribers.

4.18    The Promoter will not accept subscriptions above the level which would conflict with the Small Society Lottery legislation. 

4.19    Should the Group cease to exist, the 59 Club would be closed beforehand. All Subscribers will be notified and all Direct Debits will be suspended with immediate effect.

4.20    All enquiries or queries should be directed to the Promoter in the first instance. In the event of any dispute of whatever kind, the Promoter will refer the matter to the Committee for consideration. The Committee’s decision will be final.

4.21    The Group reserve the right to close the 59 Club at any time by giving all Subscribers 28 days’ notice and shall not be required to provide any reason whatsoever for the closure. All Direct Debits will be suspended with immediate effect in that case.

5.         Distribution of Profits, Prizes, and Arising Assets

5.1.      Each prize payment will be made by cheque from the Group’s Account to the postal address registered by the Subscriber on OSM.

5.2      In the event that a prize is not claimed, the monies will be retained by the Group. The winning Subscriber will be notified once at the end of the six months period, and the prize will be paid out later if claimed by the Subscriber in writing. The Promoter and / or the Group may request the Subscriber to provide identification documents.     

5.3      All profits of the 59 Club will be allocated by the Group at the discretion of The Committee.

5.4.      If the 59 Club is wound up, all profits remaining will be used at the discretion of The Committee.

5.5      Should the Group cease to exist, any 59 Club income would form part of the Group’s assets. Disposal of these assets would be dealt with in accordance with the latest edition of the Scout Association’s Policy, Organisation and Rules” – the current Rule 3.52 “Disposal of Group Assets at Closure” states:

d. ….   any assets remaining after the closure of a Group will automatically pass to the District Scout Council which shall use or dispose of these assets at its absolute discretion.

5.6If the 59 Club is wound up, payments received relating to future monthly draws will be returned by cheque to the Subscriber.

6.         Rule Review

6.1.      Any Committee Member or Subscriber may seek changes to the rules or clarification. These will be determined by The Committee at the next Committee Meeting.

6.2      The rules of the 59 Club will be reviewed by The Committee annually and any amendments will be circulated to the Subscribers by email.
