{"id":61,"date":"2021-03-16T21:25:18","date_gmt":"2021-03-16T21:25:18","guid":{"rendered":"https:\/\/www.emmaandtom.co.uk\/Scouts2021\/?page_id=61"},"modified":"2021-03-16T21:25:18","modified_gmt":"2021-03-16T21:25:18","slug":"59-club-rules","status":"publish","type":"page","link":"https:\/\/1stkettering.co.uk\/index.php\/fund-raising\/59-club-rules\/","title":{"rendered":"59 Club Rules"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Rules of the club<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Registration with Kettering Borough Council \u2013 Small Society Lottery Certificate No. 20\/00045\/GALOTT<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Purpose<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.1. &nbsp;&nbsp;&nbsp;&nbsp; The 1st Kettering (Parish Church) Scout Group\u2019s (\u201cThe Group\u201d) 59 Club (\u201cthe 59 Club\u201d) is a lottery intended to raise funds for the 1st Kettering Scout Group.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Legal Status<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.1. &nbsp;&nbsp;&nbsp;&nbsp; The 59 Club is registered with Kettering Borough Council (\u201cKBC\u201d) as a Small Society Lottery, and will operate under the relevant legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2. &nbsp;&nbsp;&nbsp;&nbsp; The Promoter of the 59 Club (\u201cThe Promoter\u201d) will be a Group Executive Committee (\u201cThe Committee\u201d) member appointed by the Committee. The Promoter\u2019s contact details will be available on the 59 Club page on the Group\u2019s website. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The Rules of the 59 Club will be available on the 59 Club page on the Group\u2019s website (<a href=\"http:\/\/www.1stkettering.co.uk\">http:\/\/www.1stkettering.co.uk<\/a>), and available upon request to the Promoter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The maximum number of Subscribers to the 59 Club is 59 and only appropriately registered persons can participate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The maximum value of tickets sold by the 59 Club will be \u00a34,200 per annum or \u00a3350 per monthly draw. The value of a single monthly ticket (or \u201cchance\u201d) will be \u00a35. The maximum value of prizes given in each monthly draw will be 50% of the value of the tickets sold, or \u00a3100 \u2013 whichever is the lower figure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.6&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Expenses incurred (other than for prizes) will be kept to a minimum. All expenses incurred (even when covered by donations) will be recorded and publicised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.7 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Returns of financial and other details of the 59 Club will be submitted to KBC at least once per annum as required by legislation and posted onto the Group\u2019s website<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; IT Systems<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.1The Group will hold all personal data on an on-line website, OSM (\u201cOSM\u201d), currently owned and operated by an independent external organisation entitled Online Youth Manager Ltd. This is a national data management system used by the Group. Further details of the Security and GDPR compliance are contained on the OSM website (onlinescoutmanager.co.uk).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The Group may at any time at the sole discretion of the Committee decide to use an alternative data handling system to hold the personal data. This will be communicated to all participants.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Operation<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Applicants wishing to participate in the 59 Club (\u201cSubscribers\u201d) must register onto OSM via the 59 Club link on the Group\u2019s website.&nbsp; Applicants requiring assistance to register on OSM may contact the Promoter. Subscribers must provide:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 &nbsp;&nbsp;&nbsp; their full name;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 &nbsp;&nbsp;&nbsp; date of birth;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 &nbsp;&nbsp;&nbsp; postal address; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 &nbsp;&nbsp;&nbsp; email address.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The 59 Club is open to anyone over the age of 18 years old, including members of the Committee and leaders of the Group. All participants must comply in full with the Rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Monthly draws will begin once an agreed level of subscription (\u201cthe Trigger Level\u201d) has been reached. The initial Trigger Level is set at \u00a3150 per month \u2013 i.e. 30 subscribers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.4 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; When the 59 Club becomes operational for the first time, the Promoter will invite the Subscribers via email to log into the OSM system and complete the on-line Direct Debit mandate and funds will be taken at the next appropriate date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Payment for tickets for the 59 Club will be made by Direct Debit only. Subscribers will be able to pay with either 12 monthly, 6 monthly, or 3 monthly payments. No other form of payment will be accepted. All payments will be processed via OSM. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.6&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; When the 59 Club is operational, the Promoter will activate the Direct Debit payment via the OSM system. Direct Debits will be taken for the following month\u2019s draw on the first working day following the 10<sup>th<\/sup> of the preceding month (e.g., the payment will be made on 10<sup>th<\/sup> January for the February draw).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; If the Subscriber\u2019s contribution has not been received by 23.59 on the 27<sup>th<\/sup> of the preceding month for whatever reason, the Subscriber\u2019s number will be withdrawn from that month\u2019s draw.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.8 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The Promoter will notify the Subscriber if their monthly Direct Debit fails (i.e. is rejected by the Subscriber\u2019s bank) and will advise the reason given for that rejection. It is the Subscriber\u2019s responsibility to resupply bank details via OSM and to notify the Promoter that this has been undertaken. The Subscriber will not be re-entered into the 59 Club draws until the first month for which payment using the new Direct Debit mandate is received. &nbsp;Having notified a Subscriber that their Direct Debit has failed, the Promoter is under no obligation to make any further follow up contact with the Subscriber but, at the Promoter\u2019s sole discretion, may do so. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.9&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; If the number of Subscribers falls below the Trigger Level, the 59 Club and all associated Direct Debits will be suspended. If the number of Subscribers remains below the Trigger Level for three months, the Group may take the decision to close the 59 Club.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.10 &nbsp;&nbsp; Each Subscriber will be allocated permanently the same number(s) in the range 1 to 59.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.11&nbsp;&nbsp;&nbsp; Physical tickets will not be issued to Subscribers. A list of the numbers included in each month\u2019s draw will be available for examination by Subscribers before each draw is conducted upon request by the Subscriber to the Promoter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.12&nbsp;&nbsp;&nbsp; One draw will be conducted each month, so long as Subscriber numbers remain above the Trigger Level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.13 &nbsp;&nbsp; The winning number of any individual month will reflect the Bonus Ball of the first National Lottery (\u201cLotto\u201d) drawn after 00.01 on the 1<sup>st<\/sup> of that month \u2013 on either the Wednesday or Saturday draw.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.14&nbsp;&nbsp;&nbsp; Should the Bonus Ball number from the first Lotto draw that month be an unallocated 59 Club number that month, then the draw will be continuously rolled over to the next National Lottery draw in that month until one of the allocated numbers is drawn (e.g., Saturday 1<sup>st<\/sup>\u2019s drawn Bonus Ball is a blank 59 Club number, so Wednesday 5<sup>th<\/sup>\u2019s drawn Bonus Ball will be that month\u2019s winner \u2026 and on to Saturday 8<sup>th <\/sup>until an allocated number is drawn).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.15&nbsp;&nbsp;&nbsp; Should no allocated number be drawn in any one month, the prize for that month will be rolled over until it is won.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.16 &nbsp;&nbsp; All Subscribers will be notified each month by email of the winning number within 72 hours of the draw taking place and whether the prize has been won or rolled over. A list of winners in the 12 months to 31<sup>st<\/sup> March will be included within the Group\u2019s Annual Financial Report; posted on the Group\u2019s website and will be available for inspection upon request by the Subscriber.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.17&nbsp;&nbsp;&nbsp; No refunds of tickets can be offered for any monthly draw after 00.01 on the 27<sup>th<\/sup> of the preceding month. &nbsp;Should a Subscriber wish to withdraw from the 59 Club, they should notify the Promoter in writing or by email. The Promoter will action the request as quickly as possible and will suspend that Direct Debit. &nbsp;The previously allocated permanent number will become available for offer to new Subscribers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.18&nbsp;&nbsp;&nbsp; The Promoter will not accept subscriptions above the level which would conflict with the Small Society Lottery legislation.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.19&nbsp;&nbsp;&nbsp; Should the Group cease to exist, the 59 Club would be closed beforehand. All Subscribers will be notified and all Direct Debits will be suspended with immediate effect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.20&nbsp;&nbsp;&nbsp; All enquiries or queries should be directed to the Promoter in the first instance. In the event of any dispute of whatever kind, the Promoter will refer the matter to the Committee for consideration. The Committee\u2019s decision will be final.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.21&nbsp;&nbsp;&nbsp; The Group reserve the right to close the 59 Club at any time by giving all Subscribers 28 days\u2019 notice and shall not be required to provide any reason whatsoever for the closure. All Direct Debits will be suspended with immediate effect in that case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Distribution of Profits, Prizes, and Arising Assets<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. &nbsp;&nbsp;&nbsp;&nbsp; Each prize payment will be made by cheque from the Group\u2019s Account to the postal address registered by the Subscriber on OSM.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In the event that a prize is not claimed, the monies will be retained by the Group. The winning Subscriber will be notified once at the end of the six months period, and the prize will be paid out later if claimed by the Subscriber in writing. The Promoter and \/ or the Group may request the Subscriber to provide identification documents. &nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; All profits of the 59 Club will be allocated by the Group at the discretion of The Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.4. &nbsp;&nbsp;&nbsp;&nbsp; If the 59 Club is wound up, all profits remaining will be used at the discretion of The Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Should the Group cease to exist, any 59 Club income would form part of the Group\u2019s assets. Disposal of these assets would be dealt with in accordance with the latest edition of the Scout Association\u2019s Policy, Organisation and Rules\u201d \u2013 the current Rule 3.52 \u201cDisposal of Group Assets at Closure\u201d states:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>d. \u2026. &nbsp; any assets remaining after the closure of a Group will automatically pass to the District Scout Council which shall use or dispose of these assets at its absolute discretion.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.6If the 59 Club is wound up, payments received relating to future monthly draws will be returned by cheque to the Subscriber.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Rule Review<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. &nbsp;&nbsp;&nbsp;&nbsp; Any Committee Member or Subscriber may seek changes to the rules or clarification.
